Consumer / Buyer App Terms and Conditions

 

Introduction

This Terms and Conditions applies to whoever signs up, logs into and uses the apptla app to buy goods or services offered through this app or engage in any kind of activity using the features of the app. The user agrees to this T&C explicitly before signing up and login. 

  • Here words App, Platform refer to the apptla App itself. And henceforth will be used to refer as such in this document. 
  • Here the word user refers to any user who signs up to use this app and all its features pertaining to the T&C policies listed here. 
  • Here the word seller refers to businesses or individual sellers selling goods or products through the app / platform.
  • Here the word goods or products refers to any and all products sellers are selling through the app / platform.

This section lists all and any policy related to the app / platform and lists all contact information for all clarification. 

 

App / Platform rules

 

  • Account usage terms 

User accepts to follow all rules and regulations of the app / platform on accepting this T&C. These may include all Government and all regulatory boards and legal compliances. 

  • Legal Responsibility 

Users registering an account acknowledges that the person signing up, logging in and using this app is solely responsible and accountable for their activities in the app. They are subject to all legal responsibilities according to Government of India. 

 

  • Age Consent

Users acknowledge that they are legally of age and are allowed to engage in this kind of e – commerce activity and are fully and wholly responsible and accountable for their actions.

 

  • Email id/mobile number 

Usage of Mobile Number or / and email to communicate – Email and mobile number registered with the platform are used for communication alone (with the platform and customers) and are not used for any other commercial activities without explicit consent (exclusive of any Legal Organization, Compliance boards, Regulatory Boards and Judiciary Boards).

 

  • Security of account 

Passwords and stored information in devices are property of the user and their responsibility to safeguard. The app / platform does not share or reveal this information to any 3rd party without explicit consent. Users are advised not to share any of this sensitive information without properly informing themselves of the results of such action.

 

  • Any content / transaction / activity 

Content / transaction/ activity in connection with your account is users’ responsibility. Users acknowledge that they are aware of all in app / platform content and transactions while using the app / platform. They are solely responsible for their activity in the app / platform. The app / platform is just a medium to conduct such said activity. Usage of 3rd party content without their consent is infringement of 3rd party rights. 

 

  • AUP Compliance and Breach

AUP (acceptable use policy) and any rules/regulations regarding its breach – Users comply with the rules and regulations of the platform and are acknowledging the effects of breach of said AUP. This AUP may include platform / app rules, Government Rules, Regulations, Laws and any Regulatory Board Compliances. 

 

Data and Privacy Policy 

App / Platform considers user data and its privacy as one of its core competencies. All information or data related to privacy of users and the app / platform itself are encrypted and are safely stored with highest market security standards. App / Platform has its operation base online, all data stored or used online in cloud are in accordance with high market standards and are not visible to anyone. All the data are stored, retrieved, accessed in accordance with app / platform Data Policy and are in accordance with all rules and regulations of the Indian Government. 

 

  • Data we collect may include 

      • Contact Information – Any and all information that might be used to contact users to provide for the services throughout this app. This includes information shared with any Sellers and Service Providers who may need such information to provide you with the requested services. Seller and Service Provider information that might be available to users is intended for the same purposes alone.
      • Payment and Billing Information – Any and all payment and billing information collected are for the sole purpose of providing users with information needed for online payment / payment collection and billing and taxing purposes alone.
      • Behavior information to analyze data – Any and all behavioral information collected anonymously, if any, might  be used for providing better services and improving the quality of the app and platform. All the information collected, if any, are securely stored and is used only for the purpose of analysis and improving the service and the platform.
 
  • How we use them 

      • To contact users – user information might be used to contact them regarding the service or product they wish to order. Users may receive messages related to transaction, notification and confirmation in their supplied contact mode.
      • To use this information to respond to user queries – Any and all queries the user may have, if raised with platform / app or other users in the platform / app, might be addressed using their supplied mode of communication alone. 
      • To improve our app/platform with these information – Information, any if collected, are for the sole purpose of improving the services offered or to improve the platform / app alone.
      • To analyze trends and interests of users – Trends might be analyzed to better the quality of service of the users of the app / platform.
      • To enhance security, we may use the info collected to analyze and identify all loopholes or security risks and may take necessary actions. Users will be informed by the app / platform of any such action to better inform them of these steps (if any).
      • For marketing purposes – Information might be used for marketing purposes to better serve the needs of the users in the platform / app and are not related to personal safety or integrity of their information provided to us. 
      • Transaction communication also needs user information – All transaction communication involves user information. This the users accept by agreeing to this T&C.
 
  • Sharing information 

      • Share information with 3rd parties, using our app/platform to provide certain(relevant) services to users. Here information shared is for better service quality or to provide continuing service to the user alone.  
      • Information might be shared with business partners – information shared with business partners is for providing better services or improving the quality of business alone. No personally identifiable information will be shared with 3rd party business partners without explicit consent of the users and only on consent for providing better service or continuing service.
      • Information shared with any app/platform business successors – Information shared with all business successors are natural and will always involve strictest market standards to ensure safety and integrity of user information. 
      • Any others sharing or policy changes regarding user privacy would be made active only after communicating those clearly.
 
  • 3rd party sites/apps

Information shared by users to any 3rd party has no relevance or connection to the app / platform itself. Users do so in their own understanding and knowledge and cannot expect that shared information be monitored or controlled or protected in any way by the app / platform. All grievances and issues arising out of such action have no relevance to the app / platform. Users are, in such a situation, advised to read through relevant 3rd party privacy policy before doing so.

 

  • Grievance redressal  

      • Grievance redressal for any issues with the app, data safety, privacy policy users may send their queries or questions or doubts to contact@tracogo.com 
      • Officers in charge of these will provide appropriate relief or guidelines or suggestions to such queries, questions, doubts to ensure that the issue or grievance are addressed at the earliest.   
 
  • policy Update information

      • All policy updates will become active after explicit communication to the users of the app / platform by proper channels. After the agreed time or change of policy or update of policy, users are to read and understand the changes and can raise queries to us at contact@tracogo.com for clarifications (if any).
 
  • Jurisdiction details

    • The app / platform falls under the jurisdiction of Indian rules and regulations. The app and platform follows and acts in accordance with these laws and regulations. Any contest and queries for the app / platform confirms to Indian Jurisdiction alone and any other forms of contest are not accepted.
 

Prohibited use and action

 
  • Inappropriate / False / Misleading content 

Users agree to make sure all contents, activities and transaction using the app / platform are legal and pertaining to any and all Rules of Regulations of Government of India and App / Platform Policies

 

  • Account termination clause

Account of any users who fail to meet any policies, rules and regulations mentioned in this T&C will be void of the continuous usage of the app / platform. This account termination will take effect after proper warning, notification and buffer time for users to react in accordance with standard market practices. Users may contact app / platform regarding any such inappropriate / false / misleading content if seen by mailing to content_help@tracogo.com.

Intellectual Property

 
  • App / Platform

Any and all codes, design and contents from the app / platform is the property of TraCoGo Pvt Ltd. Any and all data collected according to Data and Privacy Policy, are property of TraCoGo and has the sole rights to decide and use them in accordance with Data and Privacy policy and Rules and Regulations of government of India

 

  • User Content

    • Any and all contents the user uploads to the app / platform under their account, belongs to the user themselves. App / platform does not hold any claim over these and are not responsible in any way for them or any consequences of uploading them to the app / platform.
    • Users are to follow Rules and regulations of Government of India and all regulatory boards compliance and standards while uploading content, may it be product information or pictures or videos. Offensive and malicious contents are not allowed in the app / platform and TraCoGo holds the right to act in accordance with Legal Rules, Regulations and Laws of the Market in such circumstances. Here the account may be suspended after warning if no action is taken to remove such contents. Users may contact app / platform regarding any breach in intellectual property by mailing ip_contact@tracogo.com.

 

Payments Policy

All payment in the app / platform for usage of the app / platform itself or accessing any of the content or sales or services offered in the app / platform follows strict privacy regulations and payment policy mentioned here. 

  • Payment options used in the app or for the purpose of accessing the app / platform or for any sales or services offered in the app alone. 
  • And all transactions and payments follow the rules and Regulations of the Government of India. 
  • Users may contact the app / platform for any clarifications / issues related to payment and its policy by mailing to pay_contact@tracogo.com
  • Payments might incur taxes from time to time, according to rules and regulations of the government of India. 
 
  • Payment Methods 

Valid and legal payment methods are used to perform any and all financial transactions in the app / platform. All transactions are conducted in consent with users’ agreement. The sole responsibility of such a transaction lies with the user themselves.

 

  • Settlement Time 

Settlement time for any and all transactions depends on the payment gateway. Payments made by the user takes T+2 for working days for domestic payments. Here ‘T’ is the date of successful transaction capture. For example, the payment captured on Feb 02, 2020, 9.00 AM will be settled on Feb 04, 2020, 9.00 AM. If the settlement date is a bank holiday, the settlement will be made on the next working day after bank holiday. Refer to our payment gateway settlement policies for more details.

 

  • Disputes in Payments and Settlements

Users pay the sellers using payment gateways inside our app / platform and receive relevant notification regarding the payment. Once a dispute or question arises, 

  • Payments made are usually released within 4 days or payment capture
  • Each payment is automatically captured, usually, as soon as your bank authorized the payment.
  • If the payment is not settled within 4 – 5 days, contact the app / platform
  • Users can contact app / platform for any disputes arising out of payments or settlements by mailing contact@tracogo.com 
  • Users can contact the app / platform for any clarification regarding payment by emailing contact@tracogo.com
 

Limitations of liability

 
  • Unavoidable Errors and Unforeseen Circumstances

While the app / platform is checked and tuned to avoid any errors from occurring or causing harm to users, users’ data, users’ transactions and the company, TraCoGo cannot ensure the app / platform is completely error free due to external circumstances.

 

  • 3rd party Links 

TraCoGo has policies for Ads and Promos that are to be placed in the app / platform and regularly enforces them to ensure 3rd party websites linked to ads are secured. This may not be 100 % secure due to external circumstances unavoidable or unknown at the time of testing to make sure they are safe. So, users beware of these risks and visit 3rd party web links at their own risk and caution.

 

  • Product Description

TraCoGo has policies and complies with all regulatory boards, Government Rules and regulations to describe a product to users as accurately as possible. But not everything can be described accurately, and users should check any and all information pertaining to a product before purchase.

 

  • Order Fulfillment

  • TraCoGo provides users with app / platform and has policies to expect Sellers on the app / platform to fulfill the orders they commit to in accordance with Government rules and Regulations and Standard market practices. 
  • But Unavoidable situations and external circumstances are not under the control of the app / platform and seller, so buyers are advised to follow through patiently when such a situation arises.
  • TraCoGo expects the sellers to follow through order commitment made at the time of order placement and confirmation. 
 
  • Offensive Content Exposure

TraCoGo has policies for the contents displayed in the app / platform and users are expected to follow them. While TraCoGo makes every effort to ensure malicious or offensive content is not displayed in the app / platform, users are advised to inform the app / platform appropriately using inbuilt feedback function about any such mishap or by mailing to ip_contact@tracogo.com

 

Warranties and limitation of liability

 
  • Product warranty

Products sold by sellers, under Rules and regulation of Government of India, have market standard warranty. Users can contact the sellers directly for this purpose. Sellers / manufacturers are responsible for warranty claims on these products. App / Platform has no rights to intrude on such action. TraCoGo has policies and enforces them to make sure Sellers of all products display appropriate warranty information on Product description page for user convenience.  

 

  • Content 

Contents in platform / app may not always be accurate always, links might not lead to the right website (it was supposed to go to), sizing of clothing may not be accurate. So, users are advised to check the manufacturer website or guides in the seller or product page for any such information. Users are expected to understand this information and make informed purchases. Example – Make sure the right clothing size is selected, as size of each brand may vary, before purchasing. Users are advised to exercise caution while visiting 3rd party websites. Though Sellers in app / platform are required by platform / app to ensure accuracy of 3rd party product manufacturer links, clothing size, product description.

 

  • Errors, Inaccuracies, Omissions

TraCoGo tries to get its Sellers to describe their products (up for sale) as accurately and descriptive as possible and to comply with market laws and practices. But errors, inaccuracies and omissions may occur, in which case, users are to inform us through the in-built feedback mechanism or by mailing us at contact@tracogo.com .

 

  • Price of goods 

Users make sure they check the price of goods before adding them to your cart and just before payment. Any discrepancy here needs to be informed ASAP. Sellers need to inform the buyers of any change in prices of non-Stock items before order acceptance, any change in price can be collected after the user accepts this. Sellers are expected to follow order commitment and follow through with the order placed and confirmed. The price of goods cannot be changed after order is confirmed.

 

  • Delivery timing

Delivery Timing displayed by sellers in the app / platform is the tentative time within which delivery is possible. TraCoGo expects all sellers to fulfill their commitment to buyers as per policy and timing stated in their store information. Sellers (and their delivery service providers) are solely responsible for the delivery. Any external circumstances (unavoidable and not controllable) are beyond the control of TraCoGo and sellers. Users are advised to follow through patiently and contact sellers directly for clarifications. Users can also contact the app / platform for any disputes arising here. 

  • Delays beyond control of sellers and delivery personnel, for any reason that are of disastrous nature whether its natural or man-made are not within control of sellers and service providers. So, users need to be understanding of such situations. 
 
  • Rights to order acceptance

Sellers hold the rights to refuse an order or sale or any other activity in their shop in the app / platform. But once an order is confirmed TraCoGo expects the seller to fulfill their commitment. So, Users can contact sellers directly for information related to place orders and confirmed orders. 

 

  • Promo and Sales(offers) 

Sellers can publish ads and promos to products and events in the app / platform following the rules and regulations. Users are advised to clarify any doubts or questions regarding such offers with the sellers before availing them. App / Platform may not have much control on these ads other than ones required by ad policy. 

 

  • Rights to end sales or Use of promo codes

TraCoGo although will not intrude in promoting or promoting a product by itself, will intervene if a malicious product or product has been promoted with malicious intent. Users are advised to follow market practice standards and comply with all ad / promo rules and regulations of the Government of India. Users can inform App / Platform about such ads or promotions by using inbuilt feedback mechanism or by mailing contact@tracogo.com with relevant information.

 

Refunds and Returns Guidelines

TraCoGo being the platform / app, only hosts the sellers to sell products online, no way does it sell products. As such all such returns and refunds are subject to seller policies. 

  • TraCoGo advises sellers to follow Indian Government rules, laws and any and all regulatory board compliance policies. Users are advised to read and understand seller return and refund policies.
  • Sellers are expected to follow through the order commitment, but also follow Indian Government regulations and handle refunds and returns of any and all damaged, expired or wrong products delivered. 
  • This is governed by the consumer protection act of India.
  • As such users are asked to contact sellers about refunds or returns and to read the seller’s policy on such transactions. 
  • Users can contact the app / platform regarding any dispute arising in such circumstances though. App / Platform will try to get the issue resolved with the seller as soon as possible.

 

Amendments to your agreement

Any and all amendments to this T&C will be shown properly and marked as amendments. And will have a date and document version mentioned clearly for users to go through.

 

  • Communication about terms changes

TraCoGo will communicate to users in time, prior to Terms & Condition changes, for their acceptance by mail and notice on app / platform.

 

Jurisdiction and dispute resolution

  • Governing Law

Indian government Rules and Regulations and any and all applicable Regulatory Board compliance are followed by TraCoGo and the same is expected of its users. All disputes arising are addressed case by case and are subject to Regional Courts.

 

Contact Policy

Users are to contact TraCoGo on any and all matters that are not mentioned in the app / platform that concerns their normal purchase or other activity in the app / platform. TraCoGo will reply with a proper and definitive answer in the shortest time possible.

Display of Terms and Conditions

T&C will be displayed conveniently for users to watch at the website footer, on the app Menu and before signing up and login. App Settings links to these on the web to ensure latest info is displayed. They are also listed in payment and checkout screen (before payment for any order) for review. 

  • Getting User to accept T&A 
  • Users will have to read and consent to T&C explicitly before signing up and login.
  • Users are acquiescing to T&C by using the app, purchasing goods or services from sellers through this app and are expected to follow the T&C and all its policies.

Seller App Terms and Conditions

This Terms and Conditions applies to whoever signs up, logs into and uses the apptla seller App and/or Platform to engage in any kind of activity i.e. including e-commerce using the features of the app/platform. The user agrees to this T&C explicitly before signing up and login. 

  • Here words App, Platform refer to the apptla Apps themselves. And henceforth will be used to refer as such in this document. 
  • Here the words Seller and user refers to businesses or individual sellers selling goods and/or products through the app / platform. 
  • Here the word buyer refers to buyers who use the app / platform to buy goods or products sold through the app / platform.
  • Here the product or goods refer to any and all legal products Sellers put up for sales through the app / platform.

Platform  Rules

 

Account usage terms 

Sellers accept to follow all the rules and regulations of the app / platform on accepting this T&C. These may include all Government and all regulatory boards and legal  compliances.

Sellers acknowledge that they are aware of any and all in app / platform content, transactions while using the app / platform. They are solely responsible for their activity in the app / platform. The app / platform is just a medium to conduct such said activity. Usage of 3rd party content without owners’ consent is infringement of 3rd party rights and bound by their legal liabilities. 

 

AUP Compliance and Breach

Users comply with the rules and regulations of the platform and are acknowledging the effects of breach of said AUP. This AUP may include platform / app rules, Government Rules, Regulations, Laws and any Regulatory Board Compliances.

 

Platform Acceptable Activities

The platform / app could be used for the purposes mentioned below. And all users are subject to any and all the rules and regulations of the Indian Government(Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India.

  • Platform / app could be used only for acceptable TraCoGo activities.
  • Platform / app could be used only for the purpose of e-commerce activity. 
  • Platform / app  could be used to list, sell and track sales of products.
  • Platform / app could be used to advertise to users.
  • Platform / app could be used to create and conduct promotions.
  • Platform / app could be used to contact other users for the above said purposes alone.

 

Quality of Products and services

The sellers are advised to follow all and any rules of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India. The quality of the products sold and services offered would be subjected to all such rules and regulations (as mentioned above).

 

Transparency

Transparency of information published to users is of prime importance for the effective functioning of the app / platform.

  • Do not falsely display product information or advertisement or promotions materials or illegal contents
  • Be clear about product information and relevant services provided to facilitate sales of said products.
  • Do not attempt to deceive the users through deliberate modifications of the product and service information.
  • Being explicit about all calculations of rate, price and time helps information transparency. 

 

Compliance

Users agree to comply with the following

  • All app / platform policies.
  • All applicable laws including Data Privacy and Data Protection.
  • Not offering products or services that infringe on the copyrights, patents, or trademarks of others.
  • Not offering defective, prohibited, or otherwise illegal products and services.

 

Quality

  • Try to provide appropriate quality products for sales
  • Try to avoid selling expired products, or products with broken packaging 
  • Try to follow Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India on return and refund rules
  • Try and make sure your delivery service packs, moves and delivers products in good condition in reasonable time
  • Inform users of any unavoidable delays in delivery and pickup properly

 

Data Security    

Data security is core of the app / platform, and users by accepting this T&C agrees to keep up with this motto. Indian Government and its regulatory bodies take information security and privacy seriously and the app / platform and its users comply with any and all such rules.

 

Information Access

  • Access to user information, here buyer information, is only for the purpose of contacting them for sales transactions involved.
  • Users may contact buyers for 
    • information about the orders
    • clarification on orders
    • notification on delivery and pickup
    • return and refund processes
    • advertisement of the products sold or offers available in their shop registered in the  app / platform
  • Users may not use this information for any other purposes other than the ones mentioned above.

Information Sharing

Users cannot share information they have access to with any 3rd  party without their explicit consent. This breach in contract will be taken seriously according to the rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India. Users can share the accessed information 

  • to delivery service providers (if any) registered through the app / platform
  • to own delivery personnel for providing buyers with delivery service

Users are not to share any information of other users, buyers, wholesalers to 3rd parties in any other cases other than the ones mentioned above.

 

Breach in AUP

Breach in AUP mentioned here violates the contract agreement between users and the app / platform. App / Platform reserves the right to terminate such contract and access to app / platform

  • if users do not offer clarification in due time
  • if users repeatedly fail to meet the contract standards and any other standards set up by the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India
  • if users are found in violation of AUP, rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India
  • if users are found in violation of rules of app / platform
  • Users would be warned and notified properly before any action is taken. 
  • Users would also be given ample time to respond to any such infarction on the said contract terms and conditions.
  • Any and all actions would be taken only if they fail to respond properly and appropriately within stipulated time mentioned in the notice.

 

Data and Privacy Policy

App / Platform considers user data and its privacy as one of its primary Obligation and Security Feature. Any and all information or data related to privacy of users and the app / platform itself is encrypted and are safely stored with highest market security standards. App / Platform has its operation base online, all data stored or used online in cloud are in accordance with high market standards and are not visible to anyone including the Cloud Service Provider. All the data are stored, retrieved, accessed in accordance with app / platform Data and Privacy Policy and are in accordance with any and all rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India. 

 

Data the apptla seller App collect may include 

  • Contact Information – Any and all information that can be used to contact users to provide for the sales (including but not limited to e-commerce) throughout this app. This includes information shared with any Buyers, other Sellers and Service Providers who may need such information to provide you with the requested sales. Buyer, other Seller and Service Provider information available to sellers are intended for the above mentioned purpose alone.
  • Payment and Billing Information – Any and all payment and billing information collected are for the sole purpose of providing sellers with information needed for online payment / payment collection and billing and taxing purposes alone.
  • Behavior information to analyze data – Any and all behavioral information collected can be used for providing better services to improve the quality of the app and platform. All information collected is securely stored and are used only for the purpose of analysis alone.

 

How we use them

  • To improve our app/platform with this information – Information, any if collected, are for the sole purpose of improving the services offered and/or to improve the platform / app alone.
  • To analyze trends and interests of users – Trends may be analyzed to better the quality of service of the users of the app / platform. They are however not used to identify the users in person, i.e., no personally identifiable information would be collected and analyzed.
  • To enhance security, we might use the info collected to analyze and identify any and all Vulnerability and/or security risks and may take necessary actions. All the users would be informed of any such action(if any).

  • Information shared with other sellers or service providers – The Information shared with other sellers or service providers might be used for the relevant purpose alone. 
  • Information might be shared with business partners – information shared with business partners is for providing better services or improving the quality of business alone. No personally identifiable information would be shared with business partners without explicit consent of the users and only on consent for providing better service or continuing service.
  • Information shared with any app/platform business successors – Information shared with any and all business successors are natural and will always involve strictest market standards to ensure safety and integrity of user information. 
  • Any others sharing or policy changes regarding user privacy will be made active only after communicating those clearly.

 

 

3rd Party Sites/Apps

Information shared by users to any 3rd party has no relevance or connection to the app / platform itself. Users do so in their own understanding and knowledge and cannot expect that shared information to be monitored or controlled or protected in any way by the app / platform. All grievances and issues arising out of such action have no relevance to the app / platform. Users are, in such a situation, advised to read through relevant 3rd party privacy policy before doing so.

  • Grievance redressal for any issues with the app, data safety, privacy policy users may send their queries or questions or doubts to contact@tracogo.com 
  • Officers in charge of these may provide appropriate relief or guidelines or suggestions to such queries, questions, doubts to ensure that the issue or grievance are addressed at the earliest.

  • Any and all policy updates will become active after explicit communication to the users of the app / platform by proper channels. 
  • After the agreed time or change of policy or update of policy, users are to read and understand the changes and can raise queries to us at contact@tracogo.com for clarifications (if any).

The app and platform follows and acts in accordance with laws and regulations. App / Platform

Any and all codes, design and contents from the app / platform is the property of TraCoGo Pvt Ltd. Any and all data collected according to Data and Privacy Policy are property of TraCoGo and has the sole rights to decide and use them in accordance with  Data and Privacy policy and Rules and Regulations of government of India (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India.

 

User Content

  • Any and all contents the user uploads to the app / platform under their account, business belongs to the user themselves. App / platform does not hold any claim over these and are not responsible in any way for them or any consequences of uploading them to the app / platform.
  • Users uploading images of products or goods for sales are to ensure they are not using the images of 3rd party products or goods for any other purpose other than e-commerce alone. 
  • Users are to follow Rules and regulations of Government of India (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India while uploading content, may it be product information or pictures or videos. Offensive and malicious contents are not allowed in the app / platform and TraCoGo holds the right to act in accordance with Legal Rules, Regulations and Laws of the Market in such circumstances. Here the account may be suspended after warning if no action is taken to remove such contents. Users may contact app / platform regarding any breach in such policies by mailing ip_contact@tracogo.com 

 

Payments Policy

All payment in the app / platform for usage of the app / platform itself or accessing any of the content or sales or services offered in the app / platform follows strict privacy regulations and payment policy mentioned here. 

  • Payment options used in the app are for the purpose of accessing the app / platform or for any sales or services offered in the app alone. 
  • And all transactions and payments follow the rules and Regulations of the Government of India (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India. 
  • Users may contact app / platform for any clarifications / issues related to payment and its policy by mailing to pay_contact@tracogo.com 
  • Payments might incur taxes from time to time, according to rules and regulations of the government of India (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India. 
 
Payment Methods 

Valid and legal payment methods are used to perform any and all financial transactions in the app / platform. All transactions are conducted in consent with users’ agreement. The sole responsibility of such a transaction lies with the user themselves.

 

Settlement Time 

Settlement time for any and all transactions depends on the payment gateway. Payments made by the user takes T+2 working days for domestic payments. Here T is the date of successful transaction capture. For example, the payment captured on Feb 02, 2020, 9.00 AM will be settled on Feb 04, 2020, 9.00 AM. If the settlement date is a bank holiday, the settlement will be made on the next working day after bank holiday. Refer to our payment gateway settlement policies for more details.

 

Disputes in Payments and Settlements

Users pay the sellers using payment gateways inside our app / platform and receive relevant notification regarding the payment. Once a dispute or question arises, 

  • Payments made are usually released within 4 days of payment capture
  • Each payment is automatically captured, usually, as soon as your bank authorized the payment.
  • If the payment is not settled within 4 – 5 days, contact the app / platform
  • Users can contact app / platform for any disputes arising out of payments or settlements by mailing contact@tracogo.com 
  • Users both buyers and sellers can contact the app / platform for any clarification regarding payment by emailing contact@tracogo.com 
 
Subscription fee, subscription period and renewal time
Subscription fee, if any, are to be paid within stipulated time and sales condition and agreement signed. Period of subscription and renewal timings are calculated according to sales agreement, agreed upon by both parties.


Rights to suspend non-payee 

TraCoGo, although holds the rights to suspend, may not exercise said right to suspend non- payee accounts without prior communication and recording any issues which lead to said condition. TraCoGo will investigate any and all issues related to such a case, on a case by case basis and then suspend the account only in unavoidable situations (if any).

 

Limitations of liability

 

Unavoidable Errors in Unforeseen Circumstances

While the app / platform is checked and tuned to avoid any errors from occurring or causing harm to users, users’ data, users’ transactions and the company, TraCoGo cannot ensure the app / platform is completely error free due to external circumstances.

 

3rd party Links 

TraCoGo has policies for Ads and Promos that are to be placed in the app / platform and regularly enforces them to ensure 3rd party websites linked to ads are secured. This may not be 100 % secure due to external circumstances unavoidable or unknown at the time of testing to make sure they are safe. So, users beware of these risks and visit 3rd party web links at their own risk/discretion and request to exercise caution.

 

Product Description

TraCoGo has policies and complies with all regulatory boards, Government Rules and regulations to describe a product to users as accurately as possible. But not everything can be described accurately, and users should make sure products are described appropriately in the app / platform so that buyers could make informed decisions.

 

Order Commitment and Fulfillment

  • TraCoGo provides users with app / platform and has policies to expect Sellers on the app / platform to fulfill the orders they commit to in accordance with Government rules and Regulations and Standard market practices. 
  • But Unavoidable situations and external circumstances are not under the control of the app / platform and seller, so sellers are expected to fulfill the orders and inform buyers patiently when such a situation arises.
  • TraCoGo expects the sellers to follow through order commitment made at the time of order placement and confirmation. Order commitment is made when buyers place
    • Orders for stock items / products / goods – order is accepted (usually accepted automatically for stock items as stock management is part of the seller responsibility)
    • Orders for non-stock items / goods / products – order is confirmed by seller after reviewing Order Details
  • Order fulfillment means sellers are to provide items / goods / products in the aforementioned orders to users at the price mentioned during order commitment.
  • Sellers are to ensure that orders are packaged properly and delivered within appropriate time. Here the appropriate time range is what was mentioned during order commitment.
 
Offensive Content Exposure

TraCoGo has policies for the contents displayed in the app / platform and users are expected to follow them. 

  • Sellers are to ensure that content they upload to enable their sales of items / goods / products are allowed and within the While TraCoGo makes every effort to ensure malicious or offensive contents are not uploaded to the app.
  • The content displayed in the app / platform, sellers are to upload content (including but not limited to Pictures, Videos) from 3rd party manufacturers only for the purpose of selling those items / goods/ products. 
  • 3rd party contents are owned by 3rd parties, and using them for any other purpose here is in breach of intellectual property rights.
  • Users are advised to inform the app / platform appropriately using inbuilt feedback function about any such mishap by mailing to ip_contact@tracogo.com.

 

Warranties and limitation of liability

 

Product warranty

Products sold by sellers, under Rules and regulation of Government of India (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India, have market standard warranty. 

  • Sellers are to ensure that warranty policies are upheld at their end. 
  • Sellers are required to describe warranty information of the item / goods / products they are publishing on the app / platform for sale clearly (in accordance with Rules of Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India and Manufacturer)
  • Any links to Manufacturer website and warranty claims page or support page are to be included in the item / goods / products description page
  • Buyers are responsible for contacting Sellers or Manufacturers for warranty claims on these products. App / Platform has no rights to intrude on such action. Sellers in turn are to act according to the rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India and manufacturer warranty claims policies.
  • TraCoGo expects the sellers to abide by these procedures to ensure that buyers are informed of warranty / guarantee related information. 
 
Content Accuracy
  • Contents in platform / app may not always be accurate always, links might not lead to the right website (it was supposed to go to), sizing of clothing may not be accurate. 
  • Users are advised to exercise caution while linking 3rd party websites. Example – Make sure the clothing size guide is included for selling clothes on the app / platform (as right clothing size is selected, as size of each brand may vary). 
  • Sellers in app / platform are required by platform / app to ensure accuracy of 3rd party product manufacturer links, clothing size, product description.
 
Errors, Inaccuracies, Omissions

TraCoGo tries to get its users (Sellers) to describe their products (up for sale) as accurately and descriptive as possible and to comply with market laws and practices. But errors, inaccuracies and omissions may occur, in which case, buyers are to inform us through the in-built feedback mechanism or by mailing us at contact@tracogo.com. In-turn App / platform would inform the sellers to clarify these inaccuracy claims and correct any errors in describing the items / goods / products and warranty / guarantee information as soon as possible.  

 

Price of goods 

  • Buyers would make sure they check the price of goods before adding them to your cart and just before payment. Any discrepancy here needs to be informed as soon as possible. 
  • Sellers are required to inform the buyers of any change in prices of non-stock items before order acceptance, any change in price can be collected after the user accepts this. 
  • Sellers are expected to follow order commitment and fulfillment (follow through with the order placed and confirmed). 
  • The price of items / goods / products cannot be changed after order is confirmed.
 
Delivery timing

Delivery Timing displayed by sellers in the app / platform is the tentative time window within which delivery is possible. TraCoGo expects all Sellers to fulfill their commitment to buyers as per policy and timing stated in their store information. 

  • Sellers (and their delivery service providers) are solely responsible for delivery.
  • Any external circumstances (unavoidable and not controllable) are beyond the control of TraCoGo and sellers. 
  • Sellers are to inform buyers of any delay due to such unforeseen circumstances and are required to fulfill the orders patiently.
  • Buyers are advised to follow through patiently. 
  • Delays beyond the control of sellers and delivery personnel, for any reason that are of disastrous nature whether its natural or man-made are not within control of sellers and service providers.
 
Rights to order acceptance

Sellers hold the rights to refuse an order or sale or any other activity in their shop in the app / platform. But once an order gets confirmed TraCoGo expects the seller to fulfill their commitment and fulfillment. Buyers contacting Sellers on information related to confirmed orders expect proper clarification. App / Platform requires the Sellers to provide Buyers and App / Platform with any such clarification.

 

Ad Policy

Sellers are required by App / Platform to follow certain guidelines on ad / promo / offers pushing

  • Sellers are required to display accurate information
  • Sellers are required to commit to ad / promo / offers availed by buyers within stipulated conditions.
  • Sellers are required to publish information such as Expiry date of such offers / ads / promo along with order thresholds and any other conditions. 
  • Order commitment and fulfillment applies to any such confirmed orders that avails the offer pushed in ad / offer / promo.
  • Malicious or misrepresentation of information is not entertained by the app / platform
  • All ads / offers / promos and any such activity of similar kinds are required to be within the scope of rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India (including but not limited to Regulatory boards and market standards).
 
Promo and Sales(offers) 

Sellers can publish ads and promos to products and events in the app / platform following the rules and regulations. Users are advised to clarify any doubts or questions of buyers, regarding such offers. App / Platform may not have much control on these ads other than ones required by ad policy.

 

Rights to end sales or Use of promo codes

  • TraCoGo although will not intrude in Sellers’ promotion or promoting a product by itself, will intervene if a malicious product or product has been promoted with malicious intent. 
  • Users are advised to follow market practice standards and comply with all ad / promo rules and regulations of the Government of India (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India.
  • Sellers are expected to clarify on questions related to any malicious or false promos and ads. Buyers and the App / Platform itself requires the sellers to comply with this measure to ensure transparency and information accuracy.

          

Refunds and Returns Guidelines

TraCoGo being the platform / app, only hosts the sellers to sell products online, no way does it sell products. As such all such returns and refunds are subject to seller policies. Though TraCoGo advises sellers to follow the rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India (and all compliance policies). 

  • TraCoGo advises sellers to follow rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India. 
  • Buyers are advised to read and understand seller return and refund policies. As such Sellers are required to put such information in the Seller store page.
  • Sellers are expected to follow through the order commitment, but also follow rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India and handle refunds and returns of any and all damaged, expired or wrong products delivered. 
  • This is governed by the consumer protection act of India.
  • Sellers are required by rules and regulations of the Indian Government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India, to ensure proper return and refunds for
    • Damaged items / goods / products
    • Defective items / goods / products
    • Expired items / goods / products
    • Wrong items / goods / products
    • Misrepresented items / goods / products
  • Sellers are required to reply as soon possible for any queries or refund or return request from Buyers on any transaction valid.
  • The app / platform might contact users on behalf of the buyers in similar cases, and Sellers are required to clarify such issues as soon as possible.

 

Amendments to your agreement

Any and all amendments to this T&C will be shown properly and marked as amendments. And will have a date and document version mentioned clearly for users to go through.

 

Communication about terms changes

TraCoGo will communicate to users in time prior to Terms & Condition changes for their acceptance by mail and notice on app / platform. 

  • Users are to read and accept such changes or any updates regularly. 
  • Users can contact the app / platform about any such changes or for any other clarifications in the above said changes by mailing to contact@tracogo.com.
 

Jurisdiction and dispute resolution

 

Governing Law

 Rules and regulations of the Indian government (Central and/or State and/or Union Territories) or regulatory bodies defined by the Government of India are followed by TraCoGo and the same is expected of its users. All disputes arising are addressed case by case and are subject to Indian Government (Central and/or State and/or Union Territories) Regional Courts.

      Getting User to accept T&A  

  • Users will have to read and consent to T&C explicitly before signing up and login.
  • Users are acquiescing to T&C by using the app / platform to create shops, maintain stock, sell goods and deliver the orders (and track them).
  • Users are acquiescing to T&C by using the app, purchasing goods or services from other sellers through this app and are expected to follow the T&C and all its policies.
